By developing the Four Level Criminal Search, we can help to close the gaps currently present in most systems:
Everything starts on a local level therefore the county search is the first level. Counties have to process the arrest and criminal records before they are turned over to the state. The county only turns over the finger print card on the arrest first, leaving the disposition until last. The county search is done to find any current charges that the states do not have and the dispositions of the charges after they have gone to trial. It is not required by law that the counties report to the state repositories. This is the first gap in the system. There could be a county charge long before if ever there is a state charge.
Next the state repositories are checked. The state retains their records for life. These are arrest records only. When an individual is arrested and fingerprinted the record goes to the state to be entered into the system. If the individual was arrested but not fingerprinted then the state will not have a record of the crime. This is the second gap in the system.
Next the Federal criminal records are searched. The Federal records do not commingle their criminal records with the states, there could be no record in the state but the Federal would pull one because of the nature of the crime. Federal charges are interstate, kidnapping, drug related crimes and white collar. This is the third gap in the system.
Next the Department of Corrections records are searched. This is done to verify the information that was received on the county or state level after the individual was convicted and sentenced to the DOC. This is even a more in depth disposition as far as the sentence the parole or probation and if the individual is or was released to a half way house at any time.This is the fourth gap in the system.
