Our doors opened in 1997. With over 20 years combined experience in the industry our company is owned and operated by former federal agents now serving as private investigators. When we opened the doors of Back-groundchecks.com online, we went to work on a system that could make what information was there work to the benefit of pre-employment screening. That led to our in depth Four Level Criminal Search: COUNTY, STATE, FEDERAL AND DEPARTMENT OF CORRECTIONS. By developing the Four Level Criminal Search, we can help to close the gaps currently present in most systems: Everything starts on a local level therefore the county search is the first level. Counties have to process the arrest and criminal records before they are turned over to the state. The county only turns over the finger print card on the arrest first, leaving the disposition until last. The county search is done to find any current charges that the states do not have and the dispositions of the charges after they have gone to trial. It is not required by law that the counties report to the state repositories. This is the first gap in the system. There could be a county charge long before if ever there is a state charge. Next the state repositories are checked. The state retains their records for life. These are arrest records only. When an individual is arrested and fingerprinted the record goes to the state to be entered into the system. If the individual was arrested but not fingerprinted then the state will not have a record of the crime. This is the second gap in the system. Next the Federal criminal records are searched. The Federal records do not commingle their criminal records with the states, there could be no record in the state but the Federal would pull one because of the nature of the crime. Federal charges are interstate, kidnapping, drug related crimes and white collar. This is the third gap in the system. Next the Department of Corrections records are searched. This is done to verify the information that was received on the county or state level after the individual was convicted and sentenced to the DOC. This is even a more in depth disposition as far as the sentence the parole or probation and if the individual is or was released to a half way house at any time.This is the fourth gap in the system. THE FOUR LEVEL CRIMINAL SEARCH IS NOT DONE TO DISCRIMINATE AGAINST THE INDIVIDUAL, BUT TO VERIFY EVERYTHING THAT HAPPENED ON ANY CHARGE AND TO PROTECT THE EMPLOYER -- BECAUSE IT IS THEIR RIGHT TO KNOW! NATIONAL SEARCH & DISCOVERY HAS ACCESS TO ALL STATES AND COUNTIES IN THE US.

Do you have a database?

Answer:

Beware of companies who say they have a database. A data base is an accumulation of information a company has compiled and is re-sold to the consumer. It is not current information therefore it is not accurate information. Back-groundchecks.com uses only current information that is pulled daily on an individual. The system, be it credit, criminal, driving etc is updates every day therefore the information is current and our technicians reverify the information before it is released to the client.

Question:

What do you do to ensure your services adhere to the recent changes in the Fair Credit Reporting Act, (which has recently been interpreted to extend to the areas of pre-employment background investigations) or, are you aware that the recent changes in the law basically make companies providing services of this sort a consumer reporting agency under the law?

Answer:

Per the Fair Credit Reporting Act, no information can be obtained without the written consent of the applicant. We required a Disclosure Consent on every person being screened. No search is done without the consent of the person being screened. We also adhere to the Fair Credit Act by offering the person being screened to see a copy of their report if they request. If information is deemed incorrect by the person, we can help them potentially rectify the situation and correct their report.
